ACCEPTABLE USE POLICY
What ClosingDay is for — and what it is not.
ClosingDay is an all-in-one workspace for licensed real-estate agents and transaction coordinators — covering listings, private showings, open houses with QR-code visitor sign-in, offer management (including a public offer-submission portal), seller portal sharing, and the executed-contract transaction record. This page lists the activities we do not allow on any of those surfaces, so the line is clear from day one. Incorporated by reference into the Terms of Service.

The short version
No spam, phishing, or unsolicited bulk email through the platform.
No using AI drafts as legal advice — you are the licensed human in the loop.
No probing, scraping, scanning, or bypassing our auth/rate limits.
No uploading other people's confidential or sensitive data without a reason tied to the deal.
No illegal, harassing, infringing, or harmful content. Period.
1. Purpose and scope
This Acceptable Use Policy ("AUP") describes activities that are not permitted on ClosingDay. It applies to every user of the service — agents, transaction coordinators, anyone they share a transaction with, and anyone accessing public ClosingDay pages. The AUP is incorporated into the Terms of Service by reference; violations are Terms violations, and we may suspend, restrict, or terminate access for any breach. We may also remove offending content, withhold a refund, and (where the conduct is also unlawful) report the user to the appropriate authority.
2. Illegal activity
Do not use ClosingDay to commit or facilitate any unlawful act. This includes, without limitation: fraud, misrepresentation, money laundering, bribery, sanctions evasion, illegal discrimination (including in real-estate practice — fair-housing violations, steering, redlining), unauthorized practice of law, mortgage fraud, identity theft, and unlicensed real-estate activity in jurisdictions that require a license.
Do not upload, generate, or transmit content that violates applicable law, including content that infringes intellectual-property rights, defames a person, or violates a court order, restraining order, or non-disclosure agreement.
3. Threats, harm, and harassment
Do not use ClosingDay to threaten, harass, stalk, or intimidate any person. This includes the use of contact records, transaction details, or our email-sending features to pressure or retaliate against a counterparty, a tenant, or any third party.
Do not upload or generate content that promotes violence, self-harm, terrorism, or hatred against a protected class.
4. Email and messaging abuse
ClosingDay sends emails on your behalf only after you click Approve on a draft. You are the sender for every message that goes out, and you remain responsible for compliance with email and anti-spam laws — including the U.S. CAN-SPAM Act, Canada's CASL, and the EU's ePrivacy / GDPR rules where they apply.
Do not use the service to send spam, unsolicited bulk email, phishing messages, malware, deceptive subject lines, or messages that misrepresent the sender. Do not email anyone who has not given you a reasonable basis to contact them about a real transaction or listing.
Do not connect a Gmail or SMTP account that you are not authorized to use, and do not send messages purporting to come from a person or organization without their permission.
Repeated bounces, complaints, or marks-as-spam may trigger automatic rate-limiting and, at a high enough rate, account suspension while we investigate.
5. AI features — responsible use
ClosingDay's AI features (contract extraction, draft generation, and Scout, our in-app assistant) are designed as drafting aids that, by default, wait for your approval before anything leaves your account (auto-send is an opt-in you enable and control). They are not legal, tax, or fiduciary advice.
Do not represent AI-generated text as legal counsel, broker advice, or any form of professional opinion you are not yourself qualified and authorized to give.
Do not use AI features to draft or send disclosures, addenda, or contractual amendments without reviewing them yourself for accuracy. The drafts are starting points; you are the licensed professional.
Do not use AI features to attempt to extract personal information about people who are not parties to your transaction, generate content that impersonates another person, or produce content prohibited elsewhere in this AUP.
Do not attempt to prompt-inject, jailbreak, or otherwise manipulate the AI to bypass safety, billing, or access controls.
6. Privacy of others
Do not upload personal information about another person (a buyer, seller, lender contact, vendor, family member of a party, etc.) without a reasonable basis tied to the transaction or listing you are coordinating.
Do not upload sensitive personal information (Social Security numbers, government identification, full bank account numbers, full credit-card numbers, account passwords) unless it is genuinely required to coordinate a specific transaction, and never in unredacted form when a redacted form would suffice.
When a transaction closes or a listing is taken down, remove or redact materials that no longer need to be retained, except to the extent required for your own records-retention obligations.
Respect requests from data subjects — if a buyer or seller asks you to remove their personal information, honor that request to the extent applicable law allows. Email privacy@getclosingday.ai if you need help.
7. Public-link surfaces (submission portal, QR sign-in, seller share)
Offer-submission portal (/o/<slug>) — Use it only to receive offers on a listing you actually represent. Do not configure submission links for properties you don't have authority to list or for the purpose of soliciting offers you have no intention of conveying to the seller. Buyer agents using the portal must submit only on behalf of an actual client they are licensed to represent; submitting fabricated, duplicate, or harassing offers is prohibited and may be reported to the buyer agent's brokerage and licensing board.
Open-house QR sign-in — Display the QR poster at a bona fide open house you are hosting on a listing you represent. Do not use the visitor sign-in to harvest contacts you have no intent to follow up with for the specific property, do not transfer the list to unrelated marketing channels, and do not pre-fill visitor information without their consent. Tell visitors at the door (or on the sign-in form itself) that their information will be visible to the listing agent.
Seller portal magic links — Generate seller-portal links only for sellers who are your actual client on the listing. Do not share the link with parties who are not on the listing's representation; do not modify or remove the per-listing visibility controls in an effort to expose private notes, withdrawn offers, or unredacted buyer information; revoke the link when it is no longer needed.
Any visitor — including buyer agents, open-house attendees, and sellers receiving a portal link — agrees not to attempt to access surfaces other than the one the URL or token grants them, not to probe the public endpoints for vulnerabilities outside our disclosure program, and not to use submitted data for purposes other than the deal in question.
8. Security and integrity of the service
Do not probe, scan, or test the vulnerability of the service except under our security-disclosure program at security@getclosingday.ai.
Do not bypass or attempt to bypass authentication, rate limits, billing controls, role-based access controls, or any other system enforcement.
Do not access another user's account, transaction, or data without explicit invitation through the in-app sharing controls.
Do not reverse-engineer, decompile, scrape, or attempt to derive the source code of the service. Do not run automated tools (bots, crawlers, headless browsers) against the service except for the standard browser interactions you would perform yourself.
Do not introduce viruses, ransomware, trojans, worms, or any malicious code into the service or to any user via the service.
Do not use the service to mount attacks against third parties (denial-of-service, credential stuffing, port scanning, etc.).
9. Content restrictions
Do not upload or generate sexually explicit content, content depicting minors in any sexualized context, gratuitous violence, or content that exploits, abuses, or endangers a child.
Do not upload content that infringes intellectual-property rights — copyrighted material you are not licensed to use, trademarks you do not control, trade secrets that are not yours.
Do not upload content protected by attorney-client privilege belonging to someone other than you, or content covered by an NDA that prohibits sharing with a third-party processor.
10. Account integrity
One person, one account. Do not share login credentials with teammates — invite each teammate as their own user (agent or TC) instead.
Do not create a second account to evade a suspension, billing limit, or rate limit.
Do not provide false information at signup (name, license number, role). License numbers are recorded against your account and may be referenced if a complaint is filed.
Do not use the service in a manner that disrupts or degrades the experience for other users.
11. Reporting violations
If you believe another user is violating this AUP — sending you spam through ClosingDay, harassing a transaction party, mishandling personal information, or anything else — email abuse@getclosingday.ai with the relevant details (the user's email, when the conduct occurred, copies of any messages, and a description). For urgent security concerns, use security@getclosingday.ai instead. We aim to acknowledge reports within two business days and act on confirmed violations promptly.
12. Enforcement
When we identify or are notified of a violation, our response depends on severity, history, and intent. Possible actions include: a private warning; removal of specific content; rate-limiting of email or AI features; restriction of account features; suspension pending investigation; and termination of the account.
For serious violations — anything illegal, anything endangering another person, security attacks, or repeated AUP breaches — we may suspend or terminate the account immediately and without prior notice.
Termination for AUP violation does not entitle you to a refund of fees already paid, and surviving sections of the Terms (including indemnity and limitation of liability) continue to apply.
13. Changes to this AUP
We may update this AUP as the product evolves and as new abuse patterns emerge. Material changes will update the "Last updated" date and active users will be notified by email. Continued use of the service after a change indicates your acceptance of the revised AUP.
